29 CFR 1915.73(d): When employees are exposed to unguarded edges of decks, platforms, flats, and similar flat surfaces, more than 5 feet above a solid surface, the edges shall be guarded by adequate guardrails meeting the requirements of 1915.71(j)(1) and (2), unless the nature of the work in progress or the physical conditions prohibit the use or installation of such guardrails. a) On June 12, 2018, the midrail was not present in the guardrail section the single ladder accessed the Main Deck from the exterior staging on the north side of the Barge Commander. The employer had not installed a midrail in the unused portion of the guardrail section where employees accessed the Main Deck under the top rail. b) On June 12, 2018, sections of the chain guardrails have more than 3 inches of deflection around a floor opening near the Barge Commander 15 Foot Machine Room. c) On June 12, 2018, a 4 foot high by 5 foot wide opening did not have guardrails installed to prevent employees falling to a lower level in the bow section of the Barge Commander. d) On June 12, 2018, two temporary loading area guardrail section midrails were not connected or contacting the upper stern section surface of the Barge Commander.
