29 CFR 1910.1053(j)(3)(i): 29 CFR 1910.1053(j)(3)(i): The employer did not ensure that each employee covered by this section could demonstrate knowledge and understanding of the following: (A) the health hazards associated with exposure to respirable crystalline silica; (B) specific tasks in the workplace that could result in exposure to respirable crystalline silica; (C) specific measures the employer has implemented to protect employees from exposure to respirable crystalline silica, including engineering controls, work practices, and respirators to be used; (D) the contents of this section; and, (E) the purpose and a description of the medical surveillance program required by paragraph (i) of this section: a) Cement Mixer #1 (pipe side); October 22, 2024, and at times prior thereto, the employer did not provide effective training on silica for the employee cleaning the cement mixer. An employee using a jackhammer/chipping tool to remove concrete from mixer #1 was exposed to respirable crystalline silica hazards at 41.69 micrograms per cubic meter which is approximately 1.66 times the Action Level (AL) of 25 micrograms per cubic meter. Results were based on a 508-minute sampling period. Foley Products Company, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.1053(f)(2)(i), which was contained in OSHA inspection number 1518033, citation number 1, item number 1e and was affirmed as a final order on August 23, 2021, with respect to a workplace located at 1091 Scott Dr, Clanton AL, 35045.
