Text For Citation: 02 Item/Group: 001C Hazard:
29 CFR 1918.11(c): With respect to U.S. vessels not holding a valid Certificate of Inspection issued by the U.S. Coast Guard, entries in the registers and the issuance of certificates required by paragraph (a) of this section shall be made only by competent persons currently accredited by the U.S. Department of Labor (OSHA) for full function vessels or loose gear and wire rope testing, as appropriate, as provided in part 1919 of this chapter as follows: 29 CFR 1919.21(c): When the capacity of the boom of a crane or derrick was or will be rated in accordance with the variance of its radius, the maximum safe working loads for the various working angles of the boom and the maximum and minimum radii at which the boom may be safely used was not conspicuously posted near the controls and visible to the crane operator: (a) on or about 9/22/2021 and at times prior thereto, employees working to unload the f/v Dominic II were exposed to struck-by hazards of falling objects, in that a durable rating chart was not conspicuously posted near the controls and visible to the crane operator, specifying the maximum safe working loads for the various working angles of the boom and the maximum and minimum radii at which the boom may be safely used. (b) on or about 9/22/2021 and at times prior thereto, employees working to unload the f/v Silver Point were exposed to struck-by hazards of falling objects, in that a durable rating chart was not conspicuously posted near the controls and visible to the crane operator, specifying the maximum safe working loads for the various working angles of the boom and the maximum and minimum radii at which the boom may be safely used. Pacific Seafood was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1917.45(b)(1), which was contained in OSHA inspection number 1284075, citation number 2, item number 4, and was affirmed as a final order on 3/29/2018, with respect to a workplace located at 450 N.E. Skipanon Dr. Warrenton, OR 97146.
