29 CFR 1910.307(c): Equipment, wiring methods, and installations of equipment in hazardous (classified) locations are not intrinsically safe, approved for the hazardous (classified) location, or safe for the hazardous (classified) location: a) The employer does not provide electrical equipment that is either intrinsically safe, approved for Class II locations, or safe for Class II locations in the vicinity of the MMT Notcher Saw which operates without an exhaust ventilation and dust collection system.  Electrical equipment, wiring, and installations such as, but not limited to: the standard 240v electrical receptacle used to power the saw and the standard 120v electrical receptacle mounted on the wall behind the saw. This equipment was exposed to saw dust accumulations from the operation of the saw and subsequent dust shoveling activities. b) The employer does not provide electrical equipment that is either intrinsically safe, approved for Class II locations, or safe for Class II locations in the vicinity of the Dewalt Miter Saw which operates without an exhaust ventilation and dust collection system.  Electrical equipment, wiring, and installations such as, but not limited to: the standard 120v wall-mounted electrical receptacles used to power the saw and the standard 240v wall-mounted electrical receptacles. This equipment was exposed to saw dust accumulations from the operation of the saw and subsequent dust shoveling activities. c) The employer does not provide electrical equipment that is either intrinsically safe, approved for Class II locations, or safe for Class II locations in the vicinity of both the MMT Notcher Saw and the Dewalt Miter Saw which both operate without exhaust ventilation and dust collection systems.  Electrical equipment, wiring, and installations such as, but not limited to, the standard 120v overhead lighting. This equipment was exposed to saw dust accumulations from the operation of the saws and subsequent dust shoveling activities. The violation was most recently observed on October 12, 2016. A & D Wood Products, Inc. was previously cited for a violation of an equivalent Occupational Safety and Health Standard 1910.307(c)(2)(i), which was contained in OSHA inspection number 993582, citation number 1, item 12 and was affirmed as a final order on May 9, 2016, with respect to a workplace located at 112 Ward St., Elida, Ohio 45807. To abate this hazard, the employer must ensure that electrical equipment located in Class II locations are either intrinsically safe, approved for the Class II location, or safe for the Class II location. Changes in engineering controls (i.e. introduction of exhaust ventilation systems) and administrative practices (i.e. implementation of an appropriate housekeeping program) may allow for a change in classification of the hazardous (classified) locations to an unclassified location. Guidance for electrical installation hazardous (classified) locations involving Class II dusts can be found in the National Fire Protection Associations (NFPA) standards NFPA 499 "Recommended Practice for the Classification of Combustible Dusts and of Hazardous (Classified) Locations for Electrical Installations in Chemical Process Areas" and NFPA 70 National Electrical Code.
