29 CFR 1910.1053(i)(1)(i): The employer did not make medical surveillance available at no cost to each employee, and at a reasonable time and place, for each employee who has been occupationally exposed to respirable crystalline silica at or above the action level for 30 or more days per year: a) Cement Mixer #1 (pipe side); October 22, 2024, and at times prior thereto, the employer did not make medical surveillance available at no cost to each employee, and at a reasonable time and place, for each employee who has been occupationally exposed to respirable crystalline silica at or above the action level for 30 or more days per year. An employee using a jackhammer/chipping tool to remove concrete from mixer #1 was exposed to respirable crystalline silica hazards at 41.69 micrograms per cubic meter which is approximately 1.66 times the Action Level (AL) of 25 micrograms per cubic meter. Results were based on a 508-minute sampling period. Foley Products Company, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.1053(f)(2)(i), which was contained in OSHA inspection number 1518033, citation number 1, item number 1c and was affirmed as a final order on August 23, 2021, with respect to a workplace located at 1091 Scott Dr, Clanton AL, 35045.
