29 CFR 1910.95(g)(6): At least annually after obtaining the baseline audiogram, the employer did not obtain a new audiogram for each employee exposed at or above an 8-hour time-weighted average of 85 decibels : a) Fabrication Shop: An employee engaged in polishing granite/stone countertops, utilizing a handheld pneumatic wet stone polisher, was exposed to a continuous noise level at 93.4% of the allowable 8-hour time weighted average sound level (90dBA). The equivalent dBA level of 93.4% is approximately 89.5 dBA. The sampling was performed during 421 minutes during one shift, with zero exposure assumed for any unsampled periods of time. The employees' last audiometric test (baseline) was conducted on August 16, 2019. The employee had not participated in an audiometric test since their last baseline test. The employer did not obtain a new audiogram for affected employees annually after they completed a baseline audiogram, thus exposing employees to irreversible hearing loss, on or about, 10/12/23. All Granite & Marble Corporation dba Marble.com was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.95(c)(1), which was contained in OSHA inspection number 1309947, citation number 1, item number 2B and was affirmed as a final order on April 24, 2019, with respect to a workplace located at 1 Mt. Vernon Street, Ridgefield Park, NJ.
