29 CFR 1926.651(k)(2):Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: (a)R&L Splicing Inc. at BIA 700 & Veterans Memorial Drive, Agency Village, SD 57262: On or about and at times prior to July 10, 2023, the exposing employer did not ensure that employees were removed from the hazardous area within the vertical walled trench. Employees were conducting splicing activities within the unprotected trench in plain view of the competent person and not removed from the hazard. This condition exposed employees to cave-in hazards associated with trench wall collapse.
