29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section. a) On April 19, 2022 and times prior, an adequate protective system was not used for soil that the employer determined to be type C, while employees worked in an excavation that ranged from 5.3 to 6 feet deep to install a new commercial water line. Knife River Corporation, dba Knife River was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1358224, citation number 1, item number 1b and was affirmed as a final order on April 4, 2019, with respect to a workplace located on 3rd Avenue and Main Street in Lava Hot Springs, ID.
