Text For Citation: 02 Item/Group: 001B Hazard:
29 CFR 1918.11(c): With respect to U.S. vessels not holding a valid Certificate of Inspection issued by the U.S. Coast Guard, entries in the registers and the issuance of certificates required by paragraph (a) of this section shall be made only by competent persons currently accredited by the U.S. Department of Labor (OSHA) for full function vessels or loose gear and wire rope testing, as appropriate, as provided in part 1919 of this chapter as follows: 29 CFR 1919.21(a): The safe working load of the assembled gear and the minimum angle to the horizontal at which this load may be applied was not plainly marked at the heels of all booms along with the date of the test: (a) on or about 9/22/2021 and at times prior thereto, employees working to unload the f/v Dominic II were exposed to struck-by hazards of falling objects, in that the safe working load (SWL) was not plainly marked on the boom being used. (b) on or about 9/22/2021 and at times prior thereto, employees working to unload the f/v Silver Point were exposed to struck-by hazards of falling objects, in that the safe working load (SWL) was not plainly marked on the boom being used. Pacific Seafood was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1917.45(g)(2) which was contained in OSHA inspection number 1132562, citation number 1, item number 1, and was affirmed as a final order on 4/12/2016, with respect to a workplace located at 213 S.W. Bay Blvd. Newport, OR 97365.
