29 CFR 1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: (a) On or about June 18, 2021 for the employees working in a trench eight feet in depth with vertical walls to repair a spraying water main leak in the vicinity of Old Red Trail & Eighth Avenue NW in Mandan North Dakota. Note: This company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652(a)(1) which was contained in OSHA inspection number 1416918, citation number 1, item number 2 and was affirmed as a final order on August 27, 2019, with respect to a workplace located in the vicinity of Schafer Street & College Drive in Bismarck, North Dakota. Note: This company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652(a)(1) which was contained in OSHA inspection number 1439850, citation number 2, item number 1b and was affirmed as a final order on December 04, 2019, with respect to a workplace located in the vicinity of 313 Fox Hills Parkway in Watford City, North Dakota.
