29 CFR 1910.1053(f)(1):The employer did not use engineering and work practice controls to reduce and maintain employee exposure to respirable crystalline silica to or below the PEL, unless the employer can demonstrate that such controls are not feasible: On or about June 2, 2021, feasible engineering or administrative controls were not adequately implemented to keep employee exposure to air contaminants within the limits prescribed in the standard. The cut-off saw operator was exposed to respirable dust containing crystalline silica at 62.3769 ug/m3 which is approximately 1.2475 times the permissible exposure limit (PEL) of 50 ug/m3; exposure calculations included a zero increment for 7 minutes not sampled. At this time employees are being exposed to levels above the PEL. The Avalon Precision Casting Company, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.1000(e), which was contained in OSHA inspection number 1157899, citation number 2, item number 1/b and was affirmed as a final order on 11/4/2016, with respect to a workplace located at 15583 Brookpark Rd., Brookpark, Ohio, 44142.
