29 CFR 1915.71(j)(1): Scaffolding, staging, runways, or working platforms which are supported or suspended more than 5 feet above a solid surface, or at any distance above the water, shall be provided with a railing which has a top rail whose upper surface is from 42 to 45 inches above the upper surface of the staging, platform, or runway and a midrail located halfway between the upper rail and the staging, platform, or runway. a) On June 12, 2018, a single plank wide work surface 39 inches above the second level staging and 111 inches above the lowest point of Barge Commander Cargo Bay #4 base did not have guard rails nor were employees required to wear conventional fall protection. The two plank wide second level staging was not wide enough for a catch platform. b) On June 12, 2018, the midrail was not present in the guardrail section the single ladder accessed the third level staging of the Barge Commander Cargo Bay #4 from the second level staging. The employer had not installed a midrail in the unused portion of the guardrail section where employees accessed the third level staging under the top rail. c) On June 12, 2018, the midrail was not present along a staging section 24 inches from the bulkhead in the Barge Commander Cargo Bay #2. A toprail 39 inches above the third level staging surface was present between the staging and bulkhead. Fincantieri Marine Group, LLC dba Marinette Marine Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.23(c)(1), which was contained in OSHA inspection number 977592, citation number 1, item number 1 and was affirmed as a final order on September 9, 2014, with respect to a workplace located at 1600 Ely Street, Marinette, WI.
