29 CFR 1910.28(c)(1): Protection from falling objects. When an employee is exposed to falling objects, the employer must ensure that each employee wears head protection that meets the requirements of 29 CFR part 1910, subpart I. In addition, the employer must protect employees from falling objects by implementing one or more of the following: (1) Erecting toeboards, screens, or guardrail systems to prevent objects from falling to a lower level; (2) Erecting canopy structures and keeping potential falling objects far enough from an edge, hole, or opening to prevent them from falling to a lower level; or (3) Barricading the area into which objects could fall, prohibiting employees from entering the barricaded area, and keeping objects far enough from an edge or opening to prevent them from falling to a lower level. a) On or about April 18, 2017, toe boards were not installed around a 24 inch hatch port side, just aft of gangway on LCS 17, left open for welding hoses. The 24 inch hatch was in a working area with numerous loose items on the deck. b) On or about April 18, 2017, the installed toe boards in the WMZ around the ramp on LCS 17 had 3 gaps over 6 inches wide. c) On or about April 18, 2017, no toe boards were installed on the edge of the center area of the WMZ ramp on LCS 17. The installed toe boards in the center area of the WMZ ramp were more than 18 inches inside the ramp edge openings and would not prevent materials falling onto employees working below. d) On or about April 18, 2017, no toe boards were installed on the ends of the upmost work platforms on F3LB1 in Building 22. Fincantieri Marine Group, LLC, dba Marinette Marine Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.23(e)(4), which was contained in OSHA inspection number 985714, citation number 1, item number 2b and was affirmed as a final order on October 3, 2014, with respect to a workplace located at 1600 Ely Street, Marinette, WI.
