Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by approaching/passing vehicles while working on and/or adjacent to an active roadway: a)Murtaugh Bridges, Hwy 30; The employer does not provide and/or enforce the use of high visibility vests for employees performing work associated with the construction of a concrete bridge. The violation most recently occurred on 2/4/10. b)Hansen Bridge, Hwy 30; The employer does not provide and/or enforce the use of high visibility vests for employees performing work associated with the construction of a concrete bridge. The violation most recently occurred on 2/9/10. c)Hansen & Murtaugh Bridges, Hwy 30; The employer does not provide and/or enforce the use of high visibility vests for employees performing work associated with the construction of two concrete bridges. The violation was most recently observed on 2/11/10. Note 1: Abatement certification and documentation IS required for this item. Note 2: Among other methods, one feasible and acceptable abatement method to correct this hazard would be to follow the final rule on Worker Visibility of the Federal Highway Administration (FHWA) 23 CFR 634.3 which requires use of high visibility apparel, such as vests that meet ANSI/ISEA 107-2004 Standard for High Visibility Safety Apparel.
