North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)the hazard of being struck by and pinned beneath the Hyster 80, Model 580SLBCS, Serial D00400639AV industrial truck due to the employee not wearing the active operator restraint system or seat belt provided on the truck. the hazard of being struck by and pinned beneath the Cat, Model GC15K, Serail AT81E00279 industrial truck due to the employee not wearing the active operator restraint system or seat belt provided on the truck. Among other methods, one feasible and acceptable abatement method to correct this hazard would be the installation of the seat belt retrofit kit made available by the powered industrial truck manufacturer or distributer and requiring the operator to wear same.
