29 CFR 1926.652(b)(1)(ii): Slopes specified in paragraph b(1)(i) of this section, were not excavated to form configurations that are in accordance with the slopes shown for Type C soil in Appendix B to this subpart. a. Trench - On or about May 5, 2025, employees were exposed to caught in and struck by hazards while installing storm drain system at a depth of 9 feet inside a trench which had been sloped to a between 56 and 58 degrees. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
