29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed: Jobsite at rear of house: The employer did not ensure that employees were using stepladders in the manner for which they were designed to access the first-floor deck of the structure. The employer routinely fails to assure effective protection against ladder hazards as required by the standard, as demonstrated on or about August 22, 2023, when employees were allowed to use unopened stepladders to access the first-floor deck of the structure at the site at 17 Fayerweather St. N. Billerica, MA 01862. TNL General Construction Corp was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(4), which was contained in OSHA inspection number 1427338, citation number 1, item number 1b and was affirmed as a final order on October 3, 2019, with respect to a workplace located at 3 Cedarwood Ln., Burlington, MA.
