29 CFR 1910.134(c)(1): In a workplace where respirators were necessary to protect the health of the employee or whenever respirators are required by the employer, the employer did not establish and implement a written respiratory protection program with worksite-specific procedures following the provisions of this section, as applicable: (i) Procedures for selecting respirators for use in the workplace (ii) Medical evaluations of employees required to use respirators; (iii) Fit testing procedures for tight-fitting respirators; (iv) Procedures for proper use of respirators in routine and reasonably foreseeable emergency situations; (v) Procedures and schedules for cleaning, disinfecting, storing, inspecting, repairing, discarding, and otherwise maintaining respirators; (vi) Procedures to ensure adequate air quality, quantity, and flow of breathing air for atmosphere-supplying respirators; (vii) Training of employees in the respiratory hazards to which they are potentially exposed during routine and emergency situations; (viii) Training of employees in the proper use of respirators, including putting on and removing them, any limitations on their use, and their maintenance; and (ix) Procedures for regularly evaluating the effectiveness of the program. a) 345 S. Warren Street, Syracuse, NY 13202: On or about 03/28/2023, the employer did not develop or implement a written respiratory protection program for employees exposed to silica dust while performing concrete demolition activities including but limited to chipping concrete with a Hilti Jack Hammer and demolition hammer. Warren Garage LLC DBA CNY Parking Corp, Warren Garage Holdings LLC, Warren Garage Management L.L.C., and United Partners, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.134(c), which was contained in OSHA inspection number 1336946, citation number 1, item number 4-a and was affirmed as a final order on 09/23/2019, with respect to a workplace located at 345 S. Warren Street Garage, Syracuse, NY.
