29 CFR 1910.134(c)(2): The employer did not develop and implement a respiratory protection program in accordance with sections i and ii of this paragraph (c)(2) for employees who chose to wear respirators where respirator use was not required: On or about July 24, 2023, the employer did not have a written respiratory protection program with all of the elements required to protect the health of employees who were provided for voluntary use LPR-100 Half Mask Respirators for welding and using chemicals on manufacturing tank bed linings. Employees used chemical products such as but not limited to Klean-Strip Acetone and Raptor 1K Truck Bed Coating Black aerosol containing chemicals, including but not limited to Acetone, Xylene, and n-butyl acetate.
