29 CFR 1910.146(c)(1): The employer did not evaluate the workplace to determine if any spaces were permit-required confined spaces: (a) On or about April 28, 2022, and at times prior, at or near Milton R. Young Station Minnkota Power Cooperative, 3401 24th Street SW, Center, ND, the employer did not perform the necessary evaluation of the workspace to determine if any of the spaces were permit-required confined spaces where employees were allowed to enter a confined space and were exposed to hazards to include fly ash that had accumulated to depths of three to four feet in areas of the Plenum with thermal burn and known skin irritation and inhalation hazards.
