29 CFR 1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or was reasonably expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section: a) Northern Colorado Concrete, Inc. at the Martin Marietta Greeley Asphalt Plant, 925 N 35th Ave., Greeley, Colorado: On or about 6/19/2019 the employer did not assess the exposure of each employee who was or was reasonably expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section. 15 employees participate in concrete demolition activities on a daily basis, including but not limited to: the use of handheld powered saws to cut silica-containing concrete and the use of heavy equipment and utility vehicles to fracture silica-containing concrete. This condition exposed employees to respiratory hazards.
