Text For Citation: 02 Item/Group: 001A Hazard:
29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s). (a) Fairview Apartment Project: On or about March 19, 2019 and at times prior to, Biltmore Company did not maintain an effective program to identify, correct and/or minimize hazards to which their employees and subcontractors were exposed to. Hazards include, but are not limited to, falls from varying heights (10 foot, 20 foot & 30 foot) and housekeeping issues. Biltmore Company, LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1099379, citation number 2, item number 1b and was affirmed as a final order on January 6, 2016, with respect to a workplace located at 896 Maple Grove, Boise, ID 83708 AND was contained in OSHA inspection number 1315168, citation number 2, item number 1b and was affirmed as a final order on August 8, 2018, with respect to a workplace located at Owyhee Park, buildings 3030 & 3022, Boise, ID 83705. Note: Pursuant to 29 CFR 1903.19, the employer must submit certification AND documentation describing the steps being taken to ensure compliance, including a description of how these steps protect employees and the employees of its sub-contractors from common, obvious hazards.
