29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: a) Jobsite, 418 S Warren Ave, Malvern, PA: Employees are exposed to cave-in, engulfment and struck-by hazards. On or about July 21, 2018 the competent person who inspected the excavation permitted three employees to work in an 8 feet to 10 feet deep excavation without the use of adequate protective systems, and with water accumulated in the bottom of the excavation.
