29 CFR 1926.1203(a): Before it began work at a worksite, the employer did not ensure that a competent person identified all confined spaces in which one or more of the employees it directed may have worked, and/or did not identify each space that was a permit space, through consideration and evaluation of the elements of that space, including testing as necessary: On or about July 5, 2017, the employer had employees working within the Flocculation Basin, and the employer did not ensure that a competent person identified the spaces as a permit confined space and evaluated the potential hazards associated with work in the space. TOBIN BROS., INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, 1926.1203(A), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER: 1102251, CITATION NUMBER 1, ITEM NUMBER 3, AND WAS AFFIRMED AS A FINAL ORDER ON OCTOBER 13, 2016, WITH RESPECT TO A WORKPLACE LOCATED AT 3300 MECHANICSBURG ROAD, SPRINGFIELD, IL 62707.
