29 CFR 1910.28(b)(1)(i): (1) Unprotected sides and edges. (i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: a) On or about April 18, 2017, there was a 4 foot opening in the guard rail around the base of the E1U Mod outside of Building 22. The employee grinding scars less than 10 feet from the guard rail opening would fall over 5 feet to a concrete surface when he walk past the opening to reach the stairway to the ground. Fincantieri Marine Group, LLC, dba Marinette Marine Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.23(c)(1), which was contained in OSHA inspection number 977592, citation number 1, item number 1 and was affirmed as a final order on September 8, 2014, with respect to a workplace located at 1600 Ely Street, Marinette, WI.
