29 CFR 1910.132(a): The employer does not provide protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: A recent example of the employer's violative conduct occurred on this occasion: a) 9000 River Rd, Delair, NJ, 08110- Anodizing: The employer did not provide and ensure use of appropriate personal protective equipment, such as water and chemical resistant suits and boots, to employees who re-entered a caustic tank containing sodium hydroxide, on or about 2/3/2017. To abate this violation, the employer must establish a system to ensure that employees are given, and actually use, the correct personal protective equipment for each task including, but not limited to, work performed in the anodizing tanks. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, AND PURSUANT TO 29 CFR 1903.19, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, INCLUDING THE STEPS IT IS TAKING TO ENSURE THAT ITS EMPLOYEES ARE PROVIDED WITH PROPER PERSONAL PROTECTIVE EQUIPMENT FOR WORK PERFORMED IN THE ANODIZING TANK. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19. ALUMINUM SHAPES LLC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD, ITS EQUIVALENT, OR ESSENTIALLY SIMILAR STANDARD 29 CFR 1910.132(a), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1078913, CITATION NUMBER 1, ITEM NUMBER 2a AND WAS AFFIRMED AS A FINAL ORDER ON 3/28/2016, WITH RESPECT TO A WORKPLACE LOCATED AT 9000 RIVER ROAD, DELAIR, NEW JERSEY, 08110.
