29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck was not taken out of service until it was restored to safe operating condition. At the time of the inspection, several powered industrial trucks were found to be in need of repair, defective, or in any way unsafe, the trucks were not taken out of service until they were restored to safe operating condition. The following conditions existed: a) Several powered industrial trucks were being operated with damaged reverse/backup lights and head lights. The following forklifts had broken or defective reverse/backup lights: serial numbers 02220, 05200, 05272, 05273, 05275, 052279, 06254, and 132117. b) Four powered industrial trucks, serial numbers 02251, 05200, 05273, 05275, were missing the the LPG tank locator/indexing pins; two were being operated. Nissan forklift, serial # 02251, was one of the forklifts missing the locator/indexing pin. The forklift was involved in the accident that occurred on 8-7-2014. c) Several forklifts were being operated with defective or bypassed LPG tank gate switches, seat pressure and seatbelt switches. Maintenance records revealed seventeen forklifts had repairs performed on the switches after 8-7-2014.
