29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b). The employer does not protect employees from falling when working 6 feet or more above lower levels. This violation was observed on or about July 14, 2014, on the roof of single family dwelling where employees were exposed to an 8 foot fall hazard when performing roofing activities on a residential structure without a fall protection system. Arnulfo Rodriguez Roofing, Co., Inc. dba Rodriguez Roofing Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 960351, citation number 1, item number 1 and was affirmed as a final order on March 7, 2014, with respect to a workplace located at 3003 Meadow Prairie St., Katy, TX 77494. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees engaged in residential construction activities 6 feet or more above lower levels are protected from falling.
