29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition: Central Transport, LLC - On March 28, 2014, the employer did not ensure that powered industrial truck(s) with defects or in any way unsafe were withdrawn from service until restored to safe operating condition in the following instances: a) The Yale Forklift #25-320, in need of repair had not been withdrawn from service, the tires were damaged, and one headlight was not working. b) The Yale Forklift #25-647, in need of repair had not been withdrawn from service, the tires were damaged, the parking brake pedal was missing a cover, the brakes were not properly engaging, and the battery charging cables had damage to the outer jacket. c) The Yale Forklift #23-269, in need of repair had not been withdrawn from service, one headlight was not working.
