29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: (a) Buchman Lumber Company; Employees were subject to 8-hour time-weighted average sound levels (TWA) exceeding 85 decibels and feasible administrative or engineer controls were not used to reduce sound levels: (1) Old Planer Building; Planer Operator near the head of the planer was exposed to continuous noise at 845% of the permissible daily noise exposure (8-hour time weighted average sound level of 90 dBA) or an equivalent sound level of approximately 105 dBA during the 489-minute sampling period on 1/13/14; exposure calculations included a zero calculation increment for the 9 minutes of additional sampling, and (2) Old Planer Building; Stacker near the end of the planer chain conveyor was exposed to continuous noise at 221% of the permissible daily noise exposure (8-hour time weighted average sound level of 90 dBA) or an equivalent sound level of approximately 95 dBA during the 476-minute sampling period on 1/13/14; exposure calculations included a zero calculation increment for the 4 minutes not sampled, and (3) Old Planer Building; Stacker near the tail of the planer was exposed to continuous noise at 400% of the permissible daily noise exposure (8-hour time weighted average sound level of 90 dBA) or an equivalent sound level of approximately 100 dBA during the 508-minute sampling period on 1/13/14; exposure calculations included a zero calculation increment for the 28 minutes of additional sampling, and (4) Sawmill Building; The Edger Operator was exposed to continuous noise at 353% of the permissible daily noise exposure (8-hour time weighted average sound level of 90 dBA) or an equivalent sound level of approximately 99 dBA during the 444-minute sampling period on 1/13/14; exposure calculations included a zero calculation increment for the 26 minutes not sampled, and (5) Sawmill Building; The Edger Operator was exposed to continuous noise at 566% of the permissible daily noise exposure (8-hour time weighted average sound level of 90 dBA) or an equivalent sound level of approximately 102 dBA during the 467-minute sampling period on 12/23/13; exposure calculations included a zero calculation increment for the 13 minutes not sampled, and (6) Sawmill Building; The Lumber Stacker was exposed to continuous noise at 346% of the permissible daily noise exposure (8-hour time weighted average sound level of 90 dBA) or an equivalent sound level of approximately 98 dBA during the 467-minute sampling period on 12/23/13; exposure calculations included a zero calculation increment for the 13 minutes not sampled, and (7) Stacker Building; The Stacker Operator was exposed to continuous noise at 80% of the permissible daily noise exposure (8-hour time weighted average sound level of 90 dBA) or an equivalent sound level of approximately 88 dBA during the 469-minute sampling period on 12/23/13; exposure calculations included a zero calculation increment for the 11 minutes not sampled.
