29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program: At the facility: On October 27, 2013, and times theretofore, the employer did not implement a noise monitoring program to assess exposure of employees to high noise sources including but not limited to grinding, arc gouging, and torch cutting on exterior and interior of vessels, exposing employees to a hearing loss hazard.
