29 CFR 1926.501(b)(13): Employees engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 926.502: This violation most recently occurred on May 23, 2013, at a workplace located at 3715 Venice Drive, Irving, TX 75038; where employees were exposed to fall hazards in the following instances: Instance a.) At least one (1) employee working from the second floor of the southwest corner of the residence, exposed to potential fall hazards of an approximate ten-feet, six-inches (10-ft 6-inches); Instance b.) At least one (1) employee working from the second floor, working from the top plate of the interior frame walls, exposed to potential fall hazards of an approximate nine-feet (9-feet). SALVADOR GARCIA WAS PRECVIOUSLY CITED FOR A VIOLATION OF 29 CFR 1926.501(B)(13) OR IT'S EQUVALENT, WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 898598, CITATION NUMBER 01, ITEM 02, AND WAS AFFIRMED AS FINAL ORDER ON MAY 09, 2013 WITH RESPECT TO A WORKPLACE LOCATED AT 3715 VENICE DRIVE, IRVING, TX 75150.
