29 CFR 1926.451(h)(2)(ii): A toeboard was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below. On or about March 13, 2013, an elevated frame scaffold platform with a height of approximately 12 feet from lthe ground was released for use by employees without erecting along the edge proper toeboards. This condition exposed employees to struck-by hazards from falling materials/objects from elevated surfaces. RAFAEL BELTRAN WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD 29 CFR 1926.451(h)(2)(ii), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 313500845, CITATION NUMBER 1, ITEM NUMBER 1B AND WAS AFFIRMED AS A FINAL ORDER ON 08-23-2011, WITH RESPECT TO A WORKPLACE LOCATED AT 7501 N. MESA EL PASO, TX. 79912.
