29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a) Wayne H. Miller & Sons Roofing, LLC on or about December 19, 2012, at the address of 7005 E. Bayshore Rd. Marblehead, OH: The employer did not ensure employees were protected from falls while removing old and installing new roofing material to a residential type structure. Employees were exposed to a 24 ft. fall to the ground below. Wayne H. Miller & Sons Roofing, LLC was previously cited for a repeat violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 311608251, citation number 1, item number 2 and was affirmed as a final order on May 13, 2009, with respect to a workplace located at 331 Killdeer Lane, Elyria, OH.
