Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) The employer did not adequately protect his employees from the recognized hazards of potential toxic exposure associated with the collection, transfer, testing, and disposal of quality control samples and their subsequent waste/excess which was composed of chemicals such as phenol, dichlorophenol, acetic acid, monochloroacetic acid, acetic anhydride, etc., found at the chlorination unit. Feasible engineering and work practice controls which minimize potential employee exposure, such as but not limited to line sampling devices, covered/closed tranfer containers, and/or double valve disposal units had not been implemented.
