29 CFR 1910.178(p)(1): Where powered industrial trucks were found to be in need of repair, defective, or in any way unsafe, the trucks were not taken out of service until they had been restored to safe operating condition A.) Vortex Recycling - On or about 8/29/12 and at times prior thereto, personnel operated forklifts that contained defects associated with non-functioning safety devices (e.g. horns/back-up alarms), damaged/worn tires, and foot pedals missing rubber covers. These forklifts included but were not limited to: (1) Hyster Forklift Identified with #1 Defects included but were not limited to non-functioning horn, non-functioning strobe, and damaged/worn tires. (2) Yale Forklift Identified with #4 - Defects included but were not limited to damaged/worn tires. (3) Hyster Forklift Identified with #5 - Defects included but were not limited to damaged/worn tires and a non-functioning strobe light. (2) Hyster Forklift Identified with #2 - Defects included but were not limited to damaged/worn tires and rotator control lever missing a knob. Vortex Recycling was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.178(p)(1), which was contained in OSHA inspection number 113176614, citation number 1, item number 1 which was issued on July 15, 2008 and became final order in August 2008.
