North Carolina General Statute 95-129(1) of the Occupational Safety and Health A ct of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were expos ed to: a)261 Bonanza Dr. - where the forklift operator departed the job site lea ving a pan of mortar on the forks of the JLG extended boom rough terrain forklif t suspended approximately 8-inches above the occupied working platform of a 2-bu ck (12-feet) high tubular welded frame scaffold. Abatement note: One reasonable and feasible method of abatement would be for the employer to provide refresher training for the forklift operator. Reference: ASME B56.6-1992, Paragraph 6.2.12 , "Before leaving the operator's position: (a) bring rough terrain forklift to a complete stop; (b) place directional controls in neutral; (c) apply the parking brake; (d) lower load-engaging means fully, unless supporting an occupied eleva ted platform. In addition, when leaving the rough terrain forklift unattended: (e) stop the engine; (f) if the rough ter rain forklift must be left on an incline, block the wheels; (g) fully lower the load-engaging means."gaging
