North Carolina General Statute95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a being struck by hazard: a)establishment, maintenance shop, Hunter Engineering Company alignment lift- employees operated lift to raise vehicle for wheel alignment. The lift was equipped with two lock pins, one on each side of lift, to secure the rack when elevated. The lock pins were engaged and lift was activated to test the lock pins. The pins did not secure the lift as they were supposed to. Lift could drop vehicle striking employee. Abatement Note: Among other methods, one feasible abatement method to correct this hazard is to repair lock pins so they function properly.
