Text For Citation: 02 Item/Group: 001 Hazard: FALLING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees in that employees were exposed to falls: Employees working on top of rail cars were not protected from falls in areas, such as, but not limited to: a.in the Staging Area when employees were working from the top of rail cars b.in the Hopper Area when employees were working from the top of rail cars Employees were exposed to falls of approximately 13 feet from the top of the rail cars to the track below. Among other methods, one feasible and acceptable means of abatement would be to develop and implement a method of fall protection such as, but not limited to, a personal fall arrest system. IN THE ALTERNATIVE: 29 CFR 1910.132(a): Protective equipment, including personal protective equipment was not provided, used or maintained wherever it was necessary.
