Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards and/or struck-by hazards by not controlling the hazardous energy of another crane in the vicinity of a crane being repaired: (a) On or about July 1, 2010, in the southeast quarter of the LM Glasfiber production shop located at 1580 South 48th Street, Grand Forks, North Dakota, an employee was working from a scissors lift while engaged in maintenance and/or repair activities on the Glass Cart gantry crane when he received fatal injuries upon being struck and crushed by an overhead crane operating in the same vicinity. Abatement Note: Among other methods, one feasible and acceptable method of abatement would be to follow the requirements in ASME B30.17-2006, Section 17-3.5.
