Section 5(a)(1) of the Occupational Safety and Health Act of 1970, Section 35(a)(1) of the Virgin Islands Act 6846 as amended on July 19, 2006, 24 V.I. R&R 36 (b)(1)-(1)*, (Note:*applicable standard) Each employer shall furnish to each of it's employees a place of employment which is free from recognized hazards that are causing or are likely to cause death or serious physical harm to its employees. On or about 8-18-14: Location: In the Shop. a) The Employer failed to provide an adequate working environment. In the Shop, the temperature ranged from 90 degrees to 124 degrees fahrenheit. Despite the Mechanic shop being equipped with two large exhaust fans and two open bay type doors, the shop was extremely humid. Employees working in said conditions for a long period of time are being exposed to suffering from heat stress. Exposed employees could possibly suffer from heat stress related illnesses such as, but not limited to, heat stroke, dehydration, etc. THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19(c).
