Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: On or about December 7, 2009, employees were exposed to explosion, struck-by, and burn hazards during the operation of high-pressure vessel No. 1 which was known to be defectively designed and fabricated and thereby subject to catastrophic failure. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d). Feasible abatement methods would include, but not limited to: Conduct inspections of the vessel in accordance with API 572 Inspection Practices for Pressure Vessels, and conduct quantitative engineering evaluations of the vessel in accordance with API 579/ASME FFS-1 Fitness for Service, to demonstrate the structural integrity of the vessel and to determine whether the vessel could be safely operated in the future.
