Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY: a)Repair shop, lifts numbered 2, 3, 4, 5 and 6, on or about 07/01/09: Mechanics were working under loaded vehicle lifts having non-functioning safety locking devices in that the arm slide locks were seized. b)Repair shop, alignment rack, on or about 07/01/09: Mechanics were operating a defective lift in that the left rear safety lock had to be manually set. c)Repair shop, alignment rack, on or about 07/01/09: Mechanics were operating a defective lift in that the rack had a hydraulic leak. Among other methods, several feasible and acceptable abatement methods to correct these hazards are to: 1.Ensure that a qualified lift inspection is conducted no less than annually in accordance with ANSI/ALI ALOIM-2000, Safety Requirements for Operation, Inspection and Maintenance, Section 5 and Challenger Lifts Incorporated Manufacturer's Manual, Operation, Installation and Maintenance. 2.Ensure that qualified maintenance personnel conduct required maintenance and all service/repairs be documented and maintained in accordance with ANSI/ALI ALOIM-2000, Safety Requirements for Operation, Inspection and Maintenance, Section 6 and Challenger Lifts Incorporated Manufacturer's Manual, Operation, Installation and Maintenance. KOST TIRE, WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 312368137, CITATION NUMBER 1, ITEM 1, ISSUED ON 03/06/09.
