Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY: a)On or about 11/7/07, Outside: A Komatsu WA500 Loader and a Caterpillar 950F Loader used to move scrap metal, were equipped with non-functional reverse signal alarms. Among other methods, one feasible and acceptable method to correct this hazard is to have the audible reverse signal alarms replaced and maintained functional, in accordance with the Association of Equipment Manufactures (AEM) safety manual as well as the Manufacturers Operational Manual. Auburn Metal Processing, LLC was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard, Section 5(a)(1) which was contained in OSHA Inspection number 309377935, Citation 1, Item 1, issued on 02/16/06, with respect to a workplace located at 6984 North Street Road, Auburn, New York.n,
