North Carolina General Statute 95.0129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)the hazard of being struck by and/or pinned beneath in the event the employee falls or is thrown off the Yale, model # GLC040ADUNUAE083, serial # N484276 industrial truck that lacked an active operator restraint system or seat belt. Among other methods, one feasible and acceptable abatement method to correct this hazard would be the installation of the seat belt retrofit kit made available by the powered industrial truck manufacturer or distributor and requiring the operator to properly use it.
