Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to severe burn injuries from a dust fire and/or deflagration hazard that could have resulted from the propagation of a fire and deflagration in the air-material separators (cyclones and baghouses) that were located inside of the building structure. a) Rebond department: Air-material separators (cyclones and baghouses) were located inside of the building, as observed on or about June 6, 2007. b) Rebond department: Combustible material concentrations were allowed to pass through air moving devices (fans and blowers), as observed on or about June 6, 2007. c) Rebond department: The system design for the air material separator exhaust recycling to the interior of the building did not prevent both return of dust and transmission of energy from a fire or explosion to the building interior, as observed on or about June 6, 2007. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO RELOCATE THE AIR-MATERIAL SEPARATORS OUTSIDE OF THE FACILITY PER NFPA 654, SECTION 7.13, INSTALL AIR MOVING DEVICES PER NFPA 654, SECTION 7.12 AND RECYCLING OF AIR MATERIAL SEPARATOR EXHAUST PER NFPA 654, SECTION 6.1.3. THE EMPLOYER WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION STANDARD OR ITS EQUIVALENT STANDARD WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 305256752, CITATION NUMBER 1, ITEM NUMBER 6, ISSUED ON 12/9/04. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED
