Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards such as struck by, run over, and/or crushed against stationary objects when powered industrial trucks were driven up to employees who were standing in front of concrete barriers while retrieving water from water coolers: On or about 01/06/07, at berth 5 of Port Everglades, Florida, employees were exposed to the hazards of being run over, struck-by, and/or crushed against stationary objects when employees were retrieving water from water coolers stationed in the immediate area where powered industrial trucks were being operated. Among other methods of abatement, one feasible and acceptable method to correct this hazard is to remove employees from the area where forklifts are operating to avoid trucks from driving up to employees in front of objects. Reference ANSI - B56.1 Section 5.2.6(a), Safety Standards for Low Lift and High Lift Trucks-2005. First Repeat: Florida Transportation Services, Inc. was previously cited for a violation of the same "struck-by" hazard, which was contained in OSHA Inspection number 309209309, citation number 01, item number 001, issued on 10/02/2006, with respect to a workplace located at the reinforcing bar yard within Port Everglades, Florida, which became final order on 11/30/2006.
