Text For Citation: 02 Item/Group: 001 Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by or buried by construction debris that was being loaded into container trucks: Location: 151 Anthony St, Brooklyn, N.Y. a) The employer does not protect its employees from the hazard of being crushed by loaded material when they are working in the beds of trucks. A recent instance of this violation occurred on 04/22/06 when an employee working alone in the bed of a haul truck was crushed by material which was loaded into the truck while he was working there. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: 1)Develop and enforce a written standard operating procedure and train all the employees. 2)Install mirrors strategically installed to allow the bulldozer operator to be able to view the area where the employees are working inside the truck body from different angles. 3)Install warning devices on the top of the truck body which warn the operators of the bulldozers that a person is in the body of the truck. 4)Enforce the work rule of a buddy system (Co-worker to signal the bulldozer operator that it is safe to dump the load). Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these protect its employees from the hazards involved in entering the beds of trucks while they are being loaded.
