Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: On or about May 19, 2008, and at times prior thereto, at workplace located at Lanes Chapel Methodist Church, 8720 Old Jacksonville, Tyler, TX; employees, who operated the Sky Jack aerial platform, model number 4626, serial number 73223, were exposed to fall, struck-by, caught-between, and/or other serious hazards likely to cause death or serious injury due to: a. The "Lift Enable" and "Up/Down" selector switches were not functioning. They did not spring back to the Neutral/Stop position when either switch was released; and b. The broken "Lift Enable" switch was not the original switch; the Lift/Off/Drive select key switch has been changed out with a switch that did not require a key. AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE MEANS TO ABATE THESE HAZARDS INCLUDE, BUT ARE NOT LIMITED TO: a. Full implementation of the elements required by the American National Standards Institute (ANSI) standard A92.6-1990 (Safety requirement for Self-Propelled Elevating Work Platforms.) All operating instructions, especially the warnings shown on the Sky Jack aerial platform shall be strictly enforced; b). All malfunctions and problems of the Sky Jack aerial platform shall be removed from service for repair; and c). The Sky Jack aerial platform shall not be modified or altered unless having prior written permission of the manufacturer.
