North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Falls from unapproved climbing devices such as the "Antenna" a)between the office and production buildings - the local antenna structure which was being used as building roof access only had rungs 3/8" in diameter, had horizontal rung/brace members that were 15 3/8" apart vertically, and only had horizontal brace/rung members that were 8" wide making the structure unapproved for climbing as a ladder for building access. Abatement Note: One means of abatement would be to install a fixed ladder, portable ladder or stair unit for "Retort" building access and egress.
